Why are most rent agreements for 11 months in India?

Agreements of 12 months or more must be registered with the sub-registrar, requiring stamp duty (5-6% of annual rent) and registration fees. 11-month agreements avoid mandatory registration while still being legally valid, making them cheaper and simpler for both parties.

Is a notarized rent agreement legally valid?

Yes, a notarized rent agreement is legally valid and can be used as evidence in court. However, for agreements 12+ months, registration is mandatory by law regardless of notarization. Notarization adds authentication and is recommended for all agreements.

What should be included in a rent agreement?

Essential clauses include: property details and address, landlord and tenant details, rent amount and due date, security deposit amount, agreement duration, notice period, maintenance responsibilities, restrictions (pets, subletting), rent escalation clause, and termination conditions.

How much stamp duty is required for rent agreement?

Stamp duty varies by state: Maharashtra (0.25% of rent+deposit), Karnataka (1% of rent), Delhi (2% of average annual rent). For 11-month agreements, total stamp duty typically ranges from ₹100-500. Registration (if required) adds another ₹1,000-5,000.

Can rent agreement be made online in India?

Yes, you can create rent agreements online and even e-register them in some states (Maharashtra, Karnataka). Online agreements with e-signing have the same legal validity. For e-registration, both parties need Aadhaar-linked mobile numbers for OTP verification.
